Terms of Service

1. Acceptance of Terms

By accessing or using Milestone Teachers ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Service. These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

3. Educational Use Authorization

By using Milestone Teachers in an educational setting, the teacher or administrator confirms that:

• They have appropriate authorization from their school, board, or institution to use educational technology in the classroom
• They will use the Service only for legitimate educational purposes
• They are responsible for confirming any school, board, parent/guardian notice, consent, procurement, and approved-tool requirements that apply before student use
• They will avoid entering personally identifiable student information unless a school-approved workflow requires it, and will use initials, private aliases, or class-level notes by default

5. Acceptable Use

You agree to use Milestone Teachers only for its intended educational purposes. You may not:

• Attempt to gain unauthorized access to other users' accounts or data
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Share class codes or teacher PINs with unauthorized individuals
• Input unnecessary student personal information instead of initials, private aliases, or class-level patterns
• Use the Service for commercial purposes unrelated to education
• Attempt to reverse engineer or copy the platform's proprietary content

8. Intellectual Property

All educational content, including questions, passages, activities, and the platform design, is the property of Milestone Teachers or its licensors. You are granted a limited, non-exclusive, non-transferable license to:

You may not reproduce, distribute, or create derivative works from our content for commercial purposes or redistribution.

• Use the content for educational purposes within your classroom
• Print materials for student use within your educational setting
• Share access with authorized students in your class

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice when possible. We are not liable for any interruption or unavailability of the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• Milestone Teachers is provided "as is" without warranties of any kind, express or implied
• We do not warrant that the Service will be error-free, secure, or uninterrupted
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claims related to the Service shall not exceed the fees paid by you (if any) in the twelve months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Milestone Teachers and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

12. Changes to Terms

We reserve the right to modify these terms at any time. When we make material changes:

• We will update the "Last updated" date at the top of these terms
• We will notify registered teachers via email for significant changes
• Continued use of the Service after changes constitutes acceptance of the new terms

13. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be resolved in the courts of Ontario, Canada.

14. Termination

Either party may terminate this agreement at any time. Upon termination:

• Teachers may request account, class, and student-data deletion or export through product or support workflows, subject to backup, security, billing, contract, and legal retention limits
• We may terminate accounts for violation of these terms
• Provisions relating to intellectual property, limitation of liability, and governing law survive termination
